§ 24-4. Repair or reconstruction of sidewalks.
(a)
The city shall be responsible for the repair, reconstruction or removal of a sidewalk.
(b)
The assumption by the city of the responsibility to repair or reconstruct a sidewalk located on the public right-of-way shall not relieve an abutting owner or occupant of the responsibility set forth in section 24-2 to keep the surface of the sidewalk free from the accumulation of snow, ice, dirt and rubbish.
(c)
Nothing contained in this section shall preclude the city from requiring a property owner to construct a new sidewalk on adjacent public right-of-way as a condition of:
(1)
A development agreement;
(2)
A subdivision request;
(3)
Approval of a conditional use permit;
(4)
Other zoning request; or
(5)
At the city's request.
(d)
If a public sidewalk is damaged or removed by a private property owner, that owner is responsible to repair or replace or repair the sidewalk.
